Terms and Conditions

1.1. By subscribing, the Place gains access to features that allow it to add and manage additional information about its venue within the App.

1.2. The App provides general information, including but not limited to sunlight exposure for outdoor seating areas, which may be subject to technical or environmental variations.

1.3. Subscription fees are payable in advance and are non-refundable unless otherwise stated.

2.1. The App is intended as a visibility and informational tool only.

2.2. SunnySide ApS does not guarantee increased revenue, customer visits, or any specific business outcome as a result of subscription or use of the App.

3.1. While reasonable efforts will be made to ensure the App is available and functioning, SunnySide does not warrant uninterrupted, error-free, or fully accurate operation.

3.2. The Place acknowledges that temporary downtime, technical issues, or inaccuracies may occur.

3.3. SunnySide ApS shall not be held liable for any direct or indirect loss of revenue, profit, or goodwill arising from any malfunction, outage, delay, or error in the App.

4.1. The Place is solely responsible for the accuracy and legality of the information it provides within the App.

4.2. SunnySide ApS reserves the right to remove, edit, or restrict content that is deemed misleading, inappropriate, or in violation of applicable laws or these Terms.

5.1. To the fullest extent permitted by law, SunnySide ApS shall not be liable for:

• Any indirect, incidental, or consequential damages, including lost profits or reputational harm.
• Any reliance placed on the App's sunlight data or other features.
• Any third-party claims arising from information published by the Place.

5.2. In any case, the maximum liability of SunnySide ApS shall not exceed the total subscription fees paid by the Place in the 12 months preceding the claim.

6.1. The Place may cancel its subscription at any time; however, prepaid fees are non-refundable.

6.2. SunnySide ApS may suspend or terminate a Place's subscription with immediate effect if:

• The Place violates these Terms;
• The Place provides false or misleading information;
• The App is discontinued or materially changed.

6.3. If a Place cancels its subscription, the previously input data will be saved for up to 30 days before it is deleted.

7.1. All rights, title, and interest in the App, including software, design, and data, remain the property of SunnySide ApS.

7.2. The Place is granted a limited, non-transferable license to use the App for its business promotion during the subscription period.
